Agreement
These Terms of Use govern your use of Masqueraide, operated by Human Instinct LLC ("we", "us"). By using the site you agree to these terms, our Privacy Policy and, for purchases, our Purchase Terms. If you do not agree, do not use the site.
Eligibility
You must be at least 18, or the age of majority where you live, to create an account, upload a photo, post to the gallery or make a purchase. Minors may use the site only with a parent or legal guardian who agrees to these terms and supervises their use. Adult-rated options are only for adults.
Accounts
You are responsible for keeping your login secure and for everything done through your account. Give accurate information and tell us right away about any unauthorized use. You can stop using your account at any time.
Acceptable use
Do not: upload photos of people without their permission or of minors unless you are their parent or guardian; upload unlawful, sexual, hateful, harassing or infringing content; try to get around safety filters, age limits or usage limits; scrape, overload, reverse engineer or attack the service; resell or redistribute guides or outputs commercially; or use the site to impersonate anyone or break the law.
Your submissions
You keep ownership of photos, notes and other content you submit. You give us a limited license to use them only to run the service, such as creating your design and image. Photos are deleted after processing as described in our Privacy Policy. If you choose to share a design to our gallery, the sharing terms shown at that time also apply. You confirm you have the rights and permissions needed for anything you submit.
AI-generated content
Costume ideas, instructions, time estimates, safety tips and images are created by AI. They may be inaccurate, incomplete, imperfect or unsafe if followed without care, and may look similar to designs generated for other people. Preview images are illustrations, not a promise of how your finished costume will look or fit. We do not guarantee any result. Use your own judgment, check every material and step, and supervise children at all times. Subject to these terms and the rights of others, you may use outputs for your own personal, non-commercial purposes. We cannot promise outputs are unique or free of third-party rights.
Our content
The site, its design, logo, software and text are owned by Human Instinct LLC or its licensors and protected by intellectual-property laws. "Masqueraide" is a trademark of Human Instinct LLC. You may not copy or use them except as these terms allow.
Intellectual-property complaints
If you believe content on the site infringes your copyright or other rights, email info@humaninstinct.net with: your contact details; a description of the work and where it appears on our site (with links); a statement that you believe in good faith the use is not authorized; a statement that your notice is accurate and that you are the owner or authorized to act for them; and your physical or electronic signature. We may remove the content and notify the person who posted it, who may respond. We may end access for repeat infringers.
Suspension and termination
We may suspend, limit or end your access, remove content, or refuse service at any time if we believe you have broken these terms, created risk or legal exposure for us or others, or misused the service. Sections that by their nature should survive termination will survive.
Disclaimer of warranties
THE SITE, GUIDES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, SAFETY AND NON-INFRINGEMENT. WE DO NOT GUARANTEE FIT, AVAILABILITY OF MATERIALS, RESULTS, OR THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, HUMAN INSTINCT LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR PROPERTY DAMAGE OR INJURY ARISING FROM MAKING OR WEARING A COSTUME, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $20. Some places do not allow these limits, so they may not fully apply to you.
Indemnity
You agree to defend and hold harmless Human Instinct LLC and its team from claims, losses and costs (including reasonable legal fees) arising from your content, your misuse of the site, or your breach of these terms.
Governing law and disputes
These terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-law rules. Before filing any claim, please email info@humaninstinct.net and give us 30 days to try to resolve it informally. Any dispute that is not resolved will be handled in the state or federal courts located in Illinois, and you and we consent to their jurisdiction, except that either party may bring an eligible claim in small-claims court. Nothing here limits rights you have under consumer-protection laws where you live.
